董事長強調(diào)海外安全服務(wù)應(yīng)從“保安”變“安?!?/p>
相比歐美國家高度發(fā)展的市場化安保業(yè)務(wù),中資安保企業(yè)在量和質(zhì)方面都存在明顯差距。當前私營安保業(yè)在全球治理格局中扮演了重要角色,與其相關(guān)的國際規(guī)則也逐步形成并趨向標準化。聯(lián)合國、歐盟、北約等國際組織以及美國、英國等眾多主權(quán)國家均傾向于采購滿足國際標準認證的安保服務(wù)。中國安保業(yè)在新時期新需求下應(yīng)熟悉國際安保業(yè)的規(guī)則與標準,加強自身能力建設(shè),以適應(yīng)國際化新要求。

中國擁有龐大的海外投資和旺盛的安保需求,但安保業(yè)在全球治理中還處于邊緣地帶。與國際安保業(yè)相比,中國目前總體上還處于“保安”業(yè)態(tài),還沒有上升到精、專、國際化發(fā)展的“安保”業(yè)態(tài)。傳統(tǒng)保安業(yè)務(wù)以常規(guī)性大樓門衛(wèi)、活動和會展安保、物業(yè)管理等社會化服務(wù)為主,隊伍呈現(xiàn)人力密集型,即使結(jié)合技防,也使用一般性監(jiān)控設(shè)備和集成產(chǎn)品,大眾化和同質(zhì)化競爭明顯;安保業(yè)務(wù)則以特殊任務(wù)、精專化安全服務(wù)(部分兼有軍事化特征)為趨勢,并具備能適應(yīng)國際化的語言溝通能力和信息情報支持系統(tǒng)。

單從軟實力上來看,是否具備專業(yè)的信息收集、預判和安全風險評估能力是兩種業(yè)態(tài)的重要區(qū)別。與國際安保業(yè)相比,中國目前的業(yè)態(tài)表現(xiàn)為,一邊是規(guī)模較大的保安業(yè),人員和資本較有規(guī)模,但缺乏海外活動的能力和意愿;另一邊則是注重保護海外利益,但是規(guī)模、資本嚴重不足的安保業(yè)。出于多種原因,這兩者未能有效結(jié)合,導致了中國私營安保海外有效供給嚴重不足。
當前,在我國海外安保發(fā)展初期應(yīng)做好以下幾個方面的工作
探索建立海外風險預警機制。對海外利益拓展采取分類管理,設(shè)定風險系數(shù),通過風險評估開展海外安全預警。對風險系數(shù)較高的國家、地區(qū)、行業(yè)進行風險預警,減少在這些國家、地區(qū)、行業(yè)的活動,降低風險。開展風險控制排序,并采取“低合理可行”的風險管理過程,即通過降低可能性(預防措施)或減少其潛在后果(消減措施)來控制風險,通過風險識別、評估,采取適當處置措施,確保將風險控制于“低的可接受”的程度。

探索形成多維度信息收集、通報與融合分析機制,為海外利益保護提供信息數(shù)據(jù)條件。目前在商務(wù)部駐外經(jīng)參部門主導下,已形成境外安全管理的通報制度,外交部也啟動了全球領(lǐng)事保護機制,并公布了領(lǐng)保熱線電話。但如何有機地形成政府、企業(yè)和社會機構(gòu)的信息分級共享及融合機制還有待國家相關(guān)部門的協(xié)調(diào)整合,對此,可在“一帶一路”核心節(jié)點國家和地區(qū)選取具有基礎(chǔ)條件和資源的區(qū)域先行試點建設(shè)。

需要建立多元利益相關(guān)者參與的安保力量。目前國家提出“誰派出誰負責”的利益保護原則,使項目投資企業(yè)在實質(zhì)上成為主要的利益保護責任主體。然而企業(yè)對自身海外利益的保障能力有限,專業(yè)力量和投入都難以為繼,建議以企業(yè)自身風險管理體系為基礎(chǔ),在外交領(lǐng)事機構(gòu)的指導協(xié)調(diào)下,借助各方力量,形成“官民結(jié)合、梯次應(yīng)對”的企業(yè)海外利益保護模式。

國際安保業(yè)規(guī)制的主要內(nèi)容是武力使用的原則及武器使用管理,這在海外安保中是一個無法避免的核心問題。國內(nèi)法律政策對我國傳統(tǒng)保安企業(yè)還缺乏制度層面的支持,但海外安保服務(wù)必將面臨這一現(xiàn)實。目前中資安保公司在海外安保實踐中基本是采用購買和雇傭“當?shù)匚溲b、槍支、人員”的方式回避法律困境。

總之,從國際安保規(guī)制及行業(yè)發(fā)展的視角看中國安保業(yè)未來海外發(fā)展,機遇與挑戰(zhàn)并存,安保行業(yè)需要加快自身能力建設(shè),符合國際法律準則及行業(yè)規(guī)范,為“海外中國平安體系”建設(shè)提供重要支撐。
